Terms of Service
1. Acceptance of Terms
By accessing or using the Service, you agree to be bound by these Terms. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.
2. Service Description
S.C.G. provides a digital content verification service that applies cryptographic seals, forensic watermarks, and provenance metadata to digital assets. The Service includes:
- Generation of C2PA content provenance manifests
- Embedding of forensic watermarks (TrustMark)
- Perceptual hash computation for fuzzy matching
- Public verification certificates
- Legal Proof Packet generation
- AI training opt-out signal embedding
- Cipher Audit forensic assessments
3. Eligibility and Registration
You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. Business clients must provide a valid domain name and organisational details during onboarding.
4. Client Obligations
By submitting assets for sealing, you represent and warrant that:
- You are the original creator or authorised rights holder of the submitted content
- The content does not infringe any third-party intellectual property rights
- The content does not contain illegal, defamatory, or harmful material
- You have obtained all necessary consents for any personal data contained in the assets
- You accept responsibility for the accuracy of metadata provided during submission
S.C.G. reserves the right to refuse or revoke certification if these conditions are not met.
5. Seal Tiers and Certification
The S.C.G. Sovereign Veracity Seal is assigned in four tiers (Source, Verified, Certified, Sovereign), each representing a different level of verification. The tier assigned to an asset reflects the verification layers applied at the time of sealing.
A seal certifies the state of the asset at the time of sealing. It does not guarantee the truthfulness of the content itself, nor does it constitute a legal opinion on the ownership or validity of any intellectual property claim.
6. AI Training Opt-Out
Every sealed asset carries a machine-readable opt-out signal (cawg.training-mining: notAllowed) prohibiting use in AI model training without the rights holder's consent. This signal is embedded in the C2PA manifest and, where applicable, in the forensic watermark. S.C.G. provides the technical infrastructure for this signal but does not independently enforce compliance by third parties.
7. Legal Proof Packets
Legal Proof Packets are generated as forensic evidence documentation. They contain cryptographic evidence, timestamps, and legal citations. These documents are intended for use by qualified legal counsel and courts of competent jurisdiction. S.C.G. does not provide legal advice, and the generation of a Legal Proof Packet does not constitute a legal opinion.
8. Pricing and Payment
Subscription pricing is as published on our website at the time of purchase. Cipher Audit fees are quoted per engagement. All prices are in Swiss Francs (CHF) unless otherwise stated.
Payments are due upon invoice. Failure to pay within 30 days may result in suspension of verification services. Sealed assets remain verified during suspension — we do not retroactively revoke seals due to payment disputes.
9. Intellectual Property
You retain all intellectual property rights to your content. By using the Service, you grant S.C.G. a limited, non-exclusive licence to process your assets for the purpose of computing cryptographic hashes, embedding watermarks, and generating verification records.
The S.C.G. brand, seal designs, and verification system are the intellectual property of Swiss Cipher Group. You may display the S.C.G. seal on your assets only while your subscription is active.
10. Limitation of Liability
S.C.G. provides the Service on an "as is" basis. While we employ industry-standard cryptographic techniques, we do not warrant that the Service will prevent all forms of content misuse, copyright infringement, or unauthorised AI training.
To the maximum extent permitted by applicable law, S.C.G.'s total liability under these Terms shall not exceed the fees paid by you to S.C.G. in the 12 months preceding the event giving rise to the claim.
S.C.G. is not liable for any indirect, incidental, consequential, or punitive damages, including loss of profits, data, or business opportunities.
11. Termination
Either party may terminate the subscription with 30 days' written notice. Upon termination, your sealed assets remain verified in our public database — we do not retroactively remove verification records.
S.C.G. may immediately terminate or suspend your access if you breach these Terms, submit fraudulent content, or use the Service for illegal purposes.
12. Governing Law and Jurisdiction
13. Amendments
S.C.G. reserves the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on our website at least 30 days before taking effect. Continued use of the Service after such notice constitutes acceptance of the revised Terms.
